Can a Muslim marry someone who isn't Muslim?

It depends on which way round. A Muslim man may marry a Jewish or Christian woman, stated explicitly in the Qur’an, though many scholars discourage it where the children’s upbringing is at risk. A Muslim woman may not marry a non-Muslim man; that is agreed across all four schools. Marriage to someone of no religion, or of a polytheistic faith, is not permitted for either.

The long answer

The asymmetry surprises people, so it is worth stating precisely rather than vaguely.

A Muslim man and a woman of the People of the Book — Jewish or Christian — is permitted by explicit text. It is nonetheless discouraged by many scholars in practice, particularly where the man is not in a position to raise the children as Muslims, or where he is himself weak in practice.

A Muslim woman and a non-Muslim man is not permitted, and this is agreed by all four schools without a dissenting position among them.

Either Muslim and someone of no religion or a polytheistic one is not permitted: “And do not marry polytheistic women until they believe. And a believing slave woman is better than a polytheist, even though she might please you. And do not marry polytheistic men to your women until they believe. And a believing slave is better than a polytheist, even though he might please you. Those invite you to the Fire, but Allah invites to Paradise and to forgiveness, by His permission. And He makes clear His verses i.e., ordinances to the people that perhaps they may remember.” (Qur’an 2:221)

What this means for a convert, which is the usual reason the question is asked:

  • If you converted while married, your marriage is not automatically dissolved, and this is a case with real detail to it. It is one of the most important things to ask a scholar about early, with the actual circumstances described. Do not act on a general answer, and do not assume the worst.
  • If you are a woman engaged to a non-Muslim man, this is a genuine obstacle, and it is better to know now than later.
  • If you are a man engaged to a Christian or Jewish woman, it is permitted; the practical questions about children and household are worth thinking through anyway.

What marriage is understood to be: “And of His signs is that He created for you from yourselves mates that you may find tranquility in them; and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.” (Qur’an 30:21)

Because a marriage involves two people's actual lives, and because the rulings on an existing marriage after conversion have a lot of moving parts, this is squarely a question for a scholar who can hear the specifics rather than one to settle from a summary.

What it rests on
